SPAN Panel Limited Warranty
This Limited Warranty is effective for the Covered Products listed in Table 1 below that are delivered on or after March 1, 2025. Please review the documents at the bottom of this page for the latest limited warranty governing your Covered Product.
WHAT IS COVERED AND FOR HOW LONG
Subject to the terms and conditions set forth in this Limited Warranty, SPAN warrants to the Covered Owner (defined below) that the Covered Products listed below and delivered to the original address of installation (“Original Address”) shall be free from defects in materials and manufacturing workmanship for the applicable Limited Warranty Period (as identified in Table 1 below).
The Limited Warranty Period is valid for a given Covered Product only when it is: (1) purchased from SPAN or a SPAN authorized reseller (e.g. SPAN Authorized Installer, authorized distributor, or authorized homebuilder); (2) successfully commissioned with SPAN using the SPAN Installer App; and (3) installed by a SPAN Authorized Installer in the United States of America or Puerto Rico. As used herein, “SPAN Authorized Installer” means a person or entity that has completed training to install the Covered Product (as prescribed by SPAN), has a valid SPAN Authorized Installer Agreement on file signed by SPAN, and is in good standing with SPAN at the time of installation.
The Limited Warranty Term is not extended if your Covered Product is repaired or replaced under this Limited Warranty. Only the remainder of the original Limited Warranty Term will apply to such repaired or replaced Covered Product.
WHO CAN MAKE A CLAIM
Limited Warranty claims may only be made by, or on the behalf of, the original purchaser who purchased a Covered Product or other subsequent transferee of the Covered Product at the Original Address who provides proof of ownership of such Covered Product (a “Covered Owner”).
YOUR SOLE REMEDY
If SPAN confirms the existence of a defect that is covered by this Limited Warranty, SPAN will in its sole discretion: (1) repair your Covered Product (using new or refurbished parts) with standard ground shipping costs to/from the Original Address to be covered by SPAN; (2) ship you a replacement Covered Product or equivalent product (new or refurbished), where the costs of any necessary labor and/or dispatch of service personnel to complete the replacement will be covered by you; or (3) refund you, in whole or in part, the market price of the Covered Product at the time of the warranty claim.
If a claim is made under this Limited Warranty and SPAN or a SPAN Authorized Installer determines that the claim is not covered by this Limited Warranty, you will be liable for and shall pay for all field charges for labor or other expenses incurred in connection with such claim.
Making a Warranty Claim
If you need to file a claim under this Limited Warranty, please contact the SPAN Authorized Installer who installed your Covered Product. If you are unable to contact your SPAN Authorized Installer, please submit a service request by contacting SPAN Support using the contact information set forth at the end of this document.
For a Limited Warranty claim to be processed, it must: (i) include proof of ownership of your Covered Product; (ii) include a description of the alleged defect(s); (iii) include your Covered Product’s part number and serial number; and (iv) be made within the Limited Warranty Period specified in Table 1 or within the two year period specified below, as applicable.
Prior to returning any products, you must obtain a return authorization number from SPAN. Return shipping for the original product is the responsibility of the Covered Owner or SPAN Authorized Installer, and all returned products must be securely wrapped and packaged as directed or instructed by SPAN to avoid shipping damage.
DISCLAIMER OF WARRANTIES
THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY SPAN PROVIDES FOR THE COVERED PRODUCTS, AND THE ABOVE REMEDY IS YOUR SOLE REMEDY. SPAN LIMITS THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS OR SUFFICIENCY FOR A PARTICULAR USE OR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, TO THE DURATION OF THIS EXPRESS WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPAN SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, STATUTORY OR OTHERWISE. SPAN DOES NOT WARRANT THAT THE COVERED PRODUCTS WILL OPERATE UNINTERRUPTED, BE ERROR-FREE OR THAT ALL ERRORS CAN BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE SPAN AUTHORIZED INSTALLER OR ANY SPAN PERSONNEL SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS LIMITED WARRANTY.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
GENERAL EXCLUSIONS
This Limited Warranty does not apply to any defect or loss of product functionality resulting from any of the following: (i) abuse, misuse, improper handling, negligence, rust, or corrosion; (ii) accidents or force majeure events, including without limitation lightning, flood, earthquake, fire or other events beyond the reasonable control of SPAN; (iii) installation, commissioning, or repair of your Covered Product or its components that is performed by anyone other than SPAN or a SPAN Authorized Installer; (iv) failure to service, maintain, or repair the electrical system connected to or landed in your Covered Product according to the laws, standards, or requirements of the authority having jurisdiction; (v) failure to install, operate, service, maintain, or repair your Covered Product in accordance with the relevant owner’s manual, installation manual, datasheet, and any other instructions, documentation, or notices provided or made available by SPAN concerning the Covered Product, including through the SPAN Tech Portal (available at techportal.span.io) or on the Covered Product itself (collectively, the “Documentation”); (vi) installation of your Covered Product other than in accordance with all applicable local electrical, fire, and building codes and regulations; (vii) any attempt to modify or actual modification of your Covered Product, whether by physical means, programming or otherwise, without the express written consent of SPAN; (viii) removal and reinstallation of your Covered Product at a location other than the Original Address without the express written consent of SPAN; (ix) installation of your Covered Product on a mobile structure or dwelling such as an RV or mobile home, unless it is manufactured home that has been inspected and constructed in conformance with the applicable Federal Manufactured Home Construction and Safety Standards; (x) failure of your internet connection, including failure of any remote firmware update to the Covered Product as a result of a failure of your internet connection; (xi) causes external to your Covered Product including without limitation objects striking your Covered Product, faulty or damaged electrical wiring or connections, external electrical faults, circuit breakers or junction boxes; (xii) any damage done to your Covered Product by any components or parts not identified by SPAN as compatible with your Covered Product; (xiii) any loss of cellular connection due to an interruption or termination of your Covered Product’s mobile data services, including the sunset or shutdown of necessary cellular network technology such as 4G; and (xiv) failure to contact SPAN upon discovery of a defect covered by this Limited Warranty.
Without limiting the foregoing, this Limited Warranty does not cover (a) normal wear and tear of your Covered Product; (b) superficial defects, dents or marks that do not impact the performance of your Covered Product; or (c) theft of your Covered Product or any of its components.
EXCLUSION FOR FAILURE TO COMMISSION YOUR COVERED PRODUCT
SPAN requires the ability to remotely update the firmware of your Covered Product. Installation of these remote updates may briefly interrupt the operation of your Covered Product. By installing your Covered Product and connecting it to the internet, you consent to SPAN updating your Covered Product remotely on occasion without further notice to you.
If SPAN cannot honor this Limited Warranty for the Limited Warranty Period because the Covered Product has not been commissioned with SPAN, then we will still honor this Limited Warranty for a period of two (2) years commencing on the date that the Covered Product is delivered to the Covered Owner, subject to the limitations and exclusions set out in this Limited Warranty.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPAN SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS LIMITED WARRANTY, INCLUDING, BUT NOT LIMITED TO LOSS OF TIME, LOSS OF INCOME, LOSS OF USE, LOSS OF PERSONAL OR COMMERCIAL PROPERTY, REGARDLESS OF WHETHER CLAIMS FOR SUCH DAMAGES ARE BASED ON CONTRACT, TORT, WARRANTY OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OR OTHERWISE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. SPAN’S LIABILITY ARISING OUT OF A CLAIM UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR COVERED PRODUCT (EXCLUDING LABOR AND OTHER COSTS OF INSTALLATION).
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
LIMITATION OF USE
YOUR COVERED PRODUCT IS NOT INTENDED FOR USE WITH LIFE-SUPPORT SYSTEMS, OTHER MEDICAL EQUIPMENT, OR ANY OTHER USE WHERE PRODUCT FAILURE OR REMOTE SWITCHING OF ELECTRICAL CIRCUITS COULD LEAD TO INJURY TO PERSONS OR LOSS OF LIFE. SPAN DISCLAIMS ANY AND ALL LIABILITY ARISING OUT OF ANY SUCH USE OF YOUR COVERED PRODUCT.
GOVERNING LAW
This Limited Warranty shall be governed by the laws of the State of California, without giving effect to any conflict of laws principles that may require the application of the law of another jurisdiction.
ASSIGNMENT
SPAN expressly reserves the right to novate or assign its rights and obligations under this Limited Warranty to a third party with the demonstrated expertise and requisite resources needed to effectively discharge the obligations hereunder.
